Local Businesses Warned On “Duty Of Care” Responsibilities
Every business in England is legally responsible for what happens to its waste, from the date it is first produced until it is finally recycled or disposed of. This includes including all of the storage and handling stages in between and is known as the ‘duty of care’.
Businesses must:
- Always use a registered waste business for the collection, recycling, recovery or disposal of commercial waste;
- Register as a transporter if you transport your own waste;
- Follow certain restrictions if you move waste between countries.
The penalty is an unlimited fine if your waste is found up fly-tipped and you cannot prove that you took reasonable steps to prevent that from happening.
Waste Information Notes
Whichever way you dispose of your commercial waste, you have to make sure that you complete Waste Information Notes for all the waste originating from your business. You have to keep these Waste Information Notes for at least two years and must make them available for inspection by authorised people from the Council or the Environment Agency when asked. If you fail to produce Waste Information Notes on request to the Council or the Environment Agency, it is an offence, and you can be given a Fixed Penalty Fine of £300. It simply does not make sense to cut corners when it comes to commercial waste.
