Here is a cautionary tale about a tradesmen who tried to save money by choosing an unregulated waste carrier. If you do not follow the waste duty of care than you are taking a risk – is it really worth it just to save a few pounds?
Tradesmen Learns Costly Lesson
A tradesman employed by a householder to dispose of waste following a house renovation passed it onto someone to get rid of it. The waste was fly-tipped. The tradesman did not dispose of the material responsibly. As a result, he was fined over £5000. Fly-tipping is illegal and can harm the environment.
What is the penalty for fly-tipping?
Fly-tipping is a criminal offence, and you can be fined up to £50,000 at a Magistrates Court and get up to 6 months in prison for every offence. At a Crown Court, fines are unlimited with the maximum imprisonment term being five years.
What can I do about it?
If you employ someone to take your waste away, you have a responsibility to take reasonable steps to ensure the waste is managed legally throughout its journey to disposal.
You can do this by:
- checking the person who takes the waste is authorised.
- Requesting evidence that your waste has arrived at the intended destination and that it has been accurately described.
- Obtain a receipt with full details of the person who is taking the waste away
- Note down the registration number of the vehicle that is used to transport the waste.
